This is an agreement between Hola Wallet (referred to herein as "Hola", "Hola Wallet", "Hola Coins", "holacoins.com", "HAC", "Company", "we", "us", or "our") and you (together with Hola Wallet, the "Parties" and each a "Party"). By using the Hola Wallet website (the "Site") and Services, you agree to be bound by these Terms and conditions as well as our Privacy Policy. "Services" means any services available within the Site and the following applications (mobile, desktop, or otherwise): Hola Wallet, Hola Coins. If you do not agree to the Terms and conditions herein, do not use the Site, Mobile Application, or Services.


 

Minors are not allowed to use the services. 

You affirm that you are at least eighteen (18) years of age, or the age of legal majority in your jurisdiction if that is higher than eighteen (18) years of age.


 

You affirm that you have the right, power, capacity, and authority to lawfully enter into this Agreement.

 

We reserve the right to change, add, remove or modify the Platform, the Service, these Terms, Privacy Policy, AML Policy, Trading Policy or any content or part thereof, at any time, with or without notice, in our sole discretion. We may (but we don’t assume any such obligation) provide you a notification of any such change, add, remove or modify. You shall regularly and periodically check these Terms, Privacy Policy, Trading Policy and AML Policy including before you make any transaction on the Platform. We shall have no liability or responsibility whatsoever due to any such changes, additions, removals or modifications.

In addition, when you use any current or future Hola products, services, content, or other materials, you also will be subject to this agreement governing your use of our products and services.

 

It is your responsibility to check these terms periodically for changes. Your continued use of the Services following the published updates to the terms will mean that you accept and agree to the changes.

BY MAKING USE OF HOLA WALLET SERVICES, YOU ACKNOWLEDGE AND AGREE THAT: (1) YOU ARE AWARE OF THE RISKS ASSOCIATED WITH TRANSACTIONS OF DIGITAL CURRENCIES AND THEIR DERIVATIVES; (2) YOU SHALL ASSUME ALL RISKS RELATED TO THE USE OF HOLA WALLET SERVICES AND TRANSACTIONS OF DIGITAL CURRENCIES AND THEIR DERIVATIVES; AND (3) HOLA WALLET SHALL NOT BE LIABLE FOR ANY SUCH RISKS OR ADVERSE OUTCOMES.

You agree that you are solely responsible for all purchases, orders, actions (or the lack thereof), and decisions as related to the Services and your use of the Hola Wallet. Although the Site or Mobile Application may provide data, information, or content provided by other parties, you should not construe any such information or content as tax, legal, financial, or investment advice. We recommend that you consult with a licensed legal and financial professional prior to accessing the Site or utilizing the Services.

NO SECURITY/NO RELIANCE. 

This document does not constitute investment advice, counsel, or solicitation for investment in any security and shall not be construed in that way. 


 

HOLA WALLET MOBILE APPLICATION.

Hola Wallet application is an online Crypto trading platform that currently provides the following services;

  • Crypto-to-crypto Trading

  • P2P crypto Trading

  • Staking

  • Acquiring market-related data

  • Digital Asset Wallet

ACCOUNT CREATION. 

In order to access certain features of the Site or the Services provided, you may be required to register to create an account (“Account”). You must complete the registration process by providing Us with current, complete, and accurate information. You may also be chose or be provided a password or other access token. You are entirely responsible for maintaining the confidentiality of your password and account. You agree to notify Hola Wallet support immediately of any unauthorized use of your Account or any other breach of security. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your Account. You will not transfer your Account to anyone without first getting Our written permission. Upon completion of registration, users are known as “Registered Users.”

By registering to use a Hola Wallet Account, the user warrants that the user is an individual who is at least 18 years old, a legal person, or an organization with the full legal capacity to enter into these Terms of Use.

If the user is an individual and is not at least 18 years old, the user’s legal guardian shall be responsible for all actions and consequences resulting from the user's actions on the Hola Platform and Hola Wallet shall have the right to cancel or freeze the user’s Account in addition to filing claims against the user and the user's guardian for compensation/damages.

Each user shall have one user account only. Multiple accounts for the same user will not be allowed.

Know Your Customer (KYC) and on boarding
Hola Wallet is required to adhere to KYC requirements. Hola Wallet may undertake remote KYC procedures and video on boarding, among others.

​

The user is bound to follow all on-screen instructions and adhere to all requirements that emanate from the onboarding on to the Hola Platform.

ONE ACCOUNT.

Hola Wallet has a strict rule of one account per person. Hola Wallet uses a multi-pronged strategy to ensure HAC is not earned by fake accounts. You hereby acknowledge and agree that You currently do not have more than one Hola Wallet Account, and shall only maintain one Hola Wallet Account at all times.

Activities Prohibited on the Platform
Hola Wallet has zero tolerance towards use of its Services and Platform for any illegal purpose. Any such abuse or any suspicious or malicious activities by any User may result in forthwith restriction of access of the Platform, Hola Account, Crypto balances reflected in Hola Account, and reporting of such activities to concerned regulatory and statutory authorities as required.

USER REPRESENTATION OF INFORMATION ACCURACY. 

You represent and warrant that all information that you provide to Hola Coins through the Site or Application is accurate, complete, and truthful. You acknowledge and agree that Hola Coins and its agents are entitled to rely upon the information you provide as true, accurate, and complete without verification. We reserve the right to suspend or terminate your Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are solely responsible for updating us should your contact information change.

HOLA AFFILIATE.

  • Every affiliate request will be processed as soon as possible. Please be patient, we will process all requests. When you have been accepted as an affiliate you will receive an e-mail confirmation and Referral code.
     

  • Payment details need to be filled incorrectly. Any wrong payments made because of incorrectly provided addresses are not the responsibility of Hola Coins and will be your own loss.
     

  • Payments to affiliates are done via Hola Coins (HAC).
     

  • It is the responsibility of the affiliate to pay any applicable taxes over our affiliate payments, according to the affiliate’s country’s law.
     

  • The banners and promotional material that you are allowed to use will be sent with your affiliate confirmation email. These are our official promotional tools. Any homemade media and/or other tools you want to use, have to be approved by us first.
     

  • False information or negative publicity will risk you being removed as an affiliate and/or a ban from the Hola Coins network.
     

  • As an affiliate, you are expected to spread positivity.

TRANSFER, BUY, OR SELL HOLA COINS.
 

  • Transaction execution is possible for a User who:
    has registered and verified the Account on the Hola coins network, and Transaction is within the limits of completed verification;
    logged into his Account;
    made a deposit of Hola Coins in accordance with the instructions available on the Website;
     

  • The minimum value of a single Transaction is determined and published on the Website.
     

  • We are entitled to block the right to execute Transactions and deposit or withdraw the User’s Hola Coins.
     

  • You will not be able to cancel your Order Instruction once you have confirmed it.
     

  • All purchases of HAC are final. Purchases of HAC are non-refundable.
     

  • You currently are NOT able to sell your Hola Coins.
     

  • When you submit a P2P Transfer Instruction, you authorize us to deduct from your Cryptocurrency Account.
     

  • The per transaction Fee, payable to us.


     

DONATION.

We have been developing our technical team and working on the project, and we need your financial support. Donate to Support Development of Hola Coins Cryptocurrency. We accept different currencies such as USD, EUR, INR, etc. Hola Coins will reward these community members with HAC. Users can donate to Hola Coins while registering with the Hola Coins mobile application.

 

Note: 

  • This is not an Investment.

  • Donations are non-refundable in any situation.

  • Donations are taxable (non-tax-deductible).

  • Donations are voluntary.

  • No Receipt or Invoice.

  • The use of money (Donations) is the sole discretion of Hola Coins.

  • Please, read our Terms and conditions, Privacy policy, and White paper before making any donations.

  • The Donations in Hola Coins can lead to loss of money over short or even long periods. The information published on the Website cannot guarantee that the donations in Hola Coins would not lose money.

TAXES.

Any tax obligations are solely your responsibility and you agree that Hola Wallet has no responsibility and undertakes no obligation whatsoever relative to any tax-related matter, including but not limited to tax reporting, filing or advice. It is Your responsibility to determine, collect, report, and submit any/all taxes applicable to the payments and/or your Crypto you make or receive in connection with the use of the Platform and the Service to the appropriate tax authority.

NO COPYING. 

This agreement may not be forwarded or distributed to any other person and may not be reproduced in any manner whatsoever. Any forwarding, distribution, or reproduction of this agreement in whole or in part is unauthorized.

CANCELLATION. 

Hola Coins reserves the right to refuse or cancel your delegation or participation and/or suspend or terminate your account at any time in its sole discretion. 


 

RISKS ASSOCIATED WITH UNCERTAIN REGULATIONS AND ENFORCEMENT ACTIONS. 

The regulatory status of HAC and distributed ledger technology is unclear or unsettled in many jurisdictions. It is difficult to predict how or whether regulatory agencies may apply existing or future law or regulation with respect to such technology and its applications. It is likewise difficult to predict how or whether legislatures or regulatory agencies may implement changes to law and regulation affecting distributed ledger technology and its applications, including Hola Coins. By participating in the Hola Coins services, you expressly assume all such related risks.


 

SECURITY.

You will implement reasonable and appropriate measures designed to secure access to (i) any device associated with the email address associated with your account, and (ii) your username, password, and any other login or identifying credentials. In case you suspect a security breach in any of the above mentioned, you shall inform us immediately, so we can take measures to secure your account. 


 

RISK OF HACKING AND SECURITY WEAKNESSES.

Hackers or other malicious groups or organizations may attempt to interfere with the Hola Coins in a variety of ways, including, but not limited to, malware attacks, denial of service attacks, consensus-based attacks, Sybil attacks, smurfing and spoofing. Hola Coins takes no responsibility for and expressly disclaims responsibility for such attacks/security weaknesses. Further, Hola Coins shall bear no liability whatsoever, for any damage or interruptions caused by any computer viruses, spyware, scareware, Trojan horses, worms, or other malware that may affect your computer or other equipment, or any phishing, spoofing or other attacks.

ERRORS/CHANGES. 

The information, software, services included in or available through the Hola Coins may include inaccuracies and/or typographical errors. Changes are periodically added to the information herein. The company may make improvements and/or changes in the Website and Mobile application at any time. 


 

RISK OF UNINSURED LOSSES. 

Unlike bank accounts or accounts at financial institutions, Hola Coins are uninsured unless you specifically obtain your own private insurance to insure them. Thus, in the event of loss or loss of utility value, there is no public insurer or private insurance arranged by us, to offer recourse to you. Hola Coins takes no responsibility in this regard and expressly disclaims the same. You understand and acknowledge that risk of loss of HAC, passes from the Company to You. 


 

ACCESS TO SERVICES/CHANGE OR TERMINATION.

We may, without prior notice, change the Site, Mobile Application, Offers, stop providing the Services, or create usage limits for the Site or Mobile Application. We may permanently or temporarily terminate or suspend your access to the Application and participation in the Hola Coins without notice or liability, for any reason or for no reason, including but not limited to if, in Our sole determination, you violate any provision of these Terms and conditions.


 

LIMITATIONS OF LIABILITY.

The company, its affiliates and respective officers, directors, employees and/or agents will not be liable to you or anyone else for any damages of any kind, including, but not limited to, direct, consequential, incidental, special or indirect damages (including, but not limited to, lost profits, donation losses or other potential damages that may result from use or loss of use of the Hola Coins services)


 

USER CONDUCT. 

You agree, at all times, to utilize the Site, Application, and Services solely for the purposes for which they are intended and not for any illegal or fraudulent activity of any kind whatsoever. You agree that you will not attempt to circumvent any security measures employed by the Site, Application or Services, nor undertake any activity or conduct that would interfere with the proper function of the Site, Application or the delivery of the Services, or that would otherwise be damaging or harmful to Hola Coins.

RISKS.

You acknowledge and agree that there are risks associated with participation in the Hola Coins services.


 

RELATIONSHIP OF THE PARTIES. 

Nothing in this agreement is intended to, nor shall create any partnership, joint venture, agency, consultancy or trusteeship.

  • You breach any condition of these Cryptocurrency Terms of Use

  • You violate or we have reason to believe that you are in violation of any law or regulation that is applicable to your use of the Cryptocurrency Services

  • We have reason to believe that you are in any way involved in any fraudulent activity, money laundering, terrorism financing, or other criminal activity
